1. Information we collect

When you place an order

Checkout is handled by Stripe, our payment processor. When you buy from us, we receive your name, email address, billing and shipping addresses, the items you ordered, the amounts charged (including tax, shipping and any discount) and the status of your payment. Stripe collects your payment details directly, so we never receive or store your full card number.

When you contact us

When you use our contact form, we receive your name, email address and message. When you request wholesale pricing, we receive your contact name, email address, estimated quantity, notes about your business and whether you'd like a free sample. If you email or call us, we receive whatever you choose to share.

When you browse the Site

We use PostHog, a product analytics service, to understand how the Site is used. It collects information such as the pages you visit, the links and buttons you click, how you found the Site, your browser and device type, your approximate location based on your IP address, and technical errors you run into. It may also record how visitors move through pages, with anything typed into form fields hidden.

We also use Google Analytics, which collects similar information, such as the pages you visit, how long you stay, how you found the Site, your browser and device type, and your approximate location. Our Google Analytics account is linked to our Google Ads account, so Google also uses information about your visits for advertising, as explained in Cookies, analytics and advertising.

Our hosting provider also keeps standard server logs, including IP addresses and request details, to run and secure the Site.

2. How we use your information

We use your information to:

• process your payment, ship your order and handle returns, refunds and guarantee claims;
• email you about your order, such as your confirmation, invoice and payment updates;
• show your order's status on its order page;
• answer your messages and wholesale requests, and send samples you ask for;
• understand how the Site is used, fix problems and improve our products and content;
• show our ads on other websites and apps to people who've visited the Site, and measure how well our ads work; and
• prevent fraud, keep the Site secure and meet our legal, tax and accounting obligations.

We email you only about your orders and the requests you send us. We won't add you to a marketing email list unless you ask to join one.

3. How we share your information

We don't sell your personal information. We share it with service providers that help us run the Site and our business, and only for that purpose:

• Stripe processes payments, calculates sales tax, and creates invoices and receipts.
• Brevo delivers our order emails.
• Slack delivers new orders and messages from our contact and wholesale forms to our team.
• PostHog provides website analytics and error tracking.
• Google provides website analytics through Google Analytics.
• Hosting and database providers run the Site and store our order records.
• Shipping carriers use your name and shipping address to deliver your order.

We also let Google collect information about your visits through its cookies, so that Google can show you our ads on other websites and apps and measure how well they work. Google may combine this with other information it has about you, under its own privacy policy. Some state privacy laws call this “sharing” your information for targeted advertising. You can opt out as explained in Cookies, analytics and advertising.

We may also disclose information when the law requires it, to protect the rights, property or safety of AguaForce, our customers or others, or as part of a merger, acquisition or sale of our business, in which case this Policy continues to apply to your information.

4. Cookies, analytics and advertising

PostHog and Google Analytics use cookies and similar browser storage to recognize returning visitors and group page views into visits. Stripe uses its own cookies on its checkout page to process payments securely and prevent fraud.

We also use Google's advertising cookies. When you visit the Site, they let Google and its partners show you our ads on other websites and apps based on that visit (known as remarketing), and let us measure how well our ads work. Google explains how it uses information from sites that use its services.

To stop seeing ads personalized by Google, turn off personalized ads in Google's My Ad Center. To stop Google Analytics from collecting your visits to any website, install the Google Analytics opt-out browser add-on.

You can also block or delete cookies in your browser settings. The Site still works without analytics and advertising cookies, though checkout needs Stripe's. The Site doesn't currently respond to “Do Not Track” browser signals.

5. Your order page

Your confirmation email links to a page where you can check your order's status. Anyone who has that link can see your order's items, status and delivery address, although we partly hide your email address there. Please keep the link private.

6. How long we keep information

We keep order records for as long as we need them to fulfill orders, handle returns and guarantee claims, and meet tax and accounting requirements, which usually means several years. We keep messages and wholesale requests for as long as we need them to respond and follow up. Analytics data is kept for the retention periods set in our PostHog and Google Analytics accounts, and Google keeps data from its advertising cookies as its own privacy policy describes. When we no longer need information, we delete or anonymize it.

7. Security

The Site uses encrypted connections (HTTPS), payments are processed by Stripe, which is certified as a PCI Level 1 Service Provider, and access to customer information is limited to the people who need it. No method of sending or storing information online is completely secure, so we can't guarantee absolute security.

8. Your choices and rights

Depending on where you live, including California and other US states with privacy laws, and Canada, you may have the right to:

• know what personal information we hold about you and get a copy of it;
• correct information that's wrong;
• ask us to delete your information;
• withdraw consent you've given us; and
• opt out of targeted advertising, using the tools described in Cookies, analytics and advertising.

To make a request, email us at info@aguaforce.com. We may need to confirm your identity first, and we may keep some information where the law requires it, such as order records for tax purposes. We'll respond within the time the law requires, and we won't treat you differently for using your privacy rights. You can also have an authorized agent make a request for you.

If you're in Canada and aren't satisfied with our response, you can contact the Office of the Privacy Commissioner of Canada.

9. Children's privacy

The Site isn't directed to children under 13, and we don't knowingly collect personal information from them. You must be an adult to place an order. If you believe a child has given us personal information, contact us and we'll delete it.

10. Where your information is processed

We're based in the United States, and our service providers may process information in the United States and other countries. If you're in Canada, your information is transferred to and processed in the United States, where it may be accessible to authorities under US law.

11. Links to other sites

This Policy covers the Site only. Stripe's checkout page, our social media pages and other websites we link to have their own privacy policies, which apply when you use them.

12. Changes to this Policy

We may update this Policy as the Site and our services change. When we do, we'll change the “Last updated” date above, and if the changes are significant, we'll take reasonable steps to let you know.
