Terms of Use

1. Using the site

You can use the Site to learn about AguaForce, find exercise ideas, buy our products and get in touch with us. You must be at least 18, or the age of majority where you live, to place an order. Younger visitors may use the Site with the involvement of a parent or guardian.

When you use the Site, please don't:

• break the law or infringe anyone else's rights;
• give false or misleading information, or someone else's information, at checkout or in our contact and wholesale forms;
• send spam, abusive messages or harmful code through our forms;
• try to gain unauthorized access to, disrupt or overload the Site or the systems behind it; or
• use bots or other automated tools on the Site, except as allowed in Search engines and AI tools below.

We may suspend access to the Site, refuse service or cancel orders if we reasonably believe these Terms have been broken.

2. Search engines and AI tools

We want people to find AguaForce wherever they look for answers. Search engines, AI crawlers, and AI search and assistant tools are welcome to crawl and index the Site's public pages, to summarize, quote and link to them in search results and in answers to their users, and to use them to train and improve AI models.

When you do, please follow our robots.txt file, identify your crawler with an accurate user agent, and crawl at a pace that doesn't slow the Site down for other visitors. A plain-text summary and directory of the Site for AI tools is at llms.txt.

This doesn't cover pages that our robots.txt file excludes, such as order confirmation and order status pages, or automated use of our checkout, contact or wholesale forms.

Search engines and AI tools write their own summaries, which can be incomplete, out of date or wrong. We're not responsible for what they say about us or our products. The Site, these Terms and your order confirmation are what apply to your purchase.

3. Health and safety

AguaForce weights are fitness equipment, and all exercise carries some risk of injury. Please read this section before you start.

• Check with your doctor first. Talk to your doctor or physiotherapist before starting a new exercise program, especially if you are pregnant, have a medical condition such as heart disease, high blood pressure, arthritis or osteoporosis, or are recovering from an injury or surgery.
• Stop if something feels wrong. Stop exercising right away and get medical advice if you feel pain, dizziness, faintness, shortness of breath or chest discomfort.
• Start light and move with control. Begin with little or no water and add more only when you can keep good form. The water shifts as you move, so use slow, controlled movements.
• Fill and close it properly. Fill it only with tap water, no higher than the top fill line, and close the lid firmly so the gasket seals before each use. Empty it before leaving it anywhere below freezing.
• Keep a secure grip and clear space. Keep your hands dry, or wear workout gloves, for fast or swinging moves. Make sure there's room around you, and set the weight down rather than dropping it.
• Inspect it regularly. Stop using a weight that is cracked, damaged or leaking, and contact us.
• Take care in the pool. AguaForce weights are not flotation or lifesaving devices. Never rely on one to keep you afloat, and use them in the water only where it's safe, such as in a supervised class.
• Supervise children. Children should use AguaForce weights only with adult supervision.

You're responsible for choosing exercises and weights that suit you. To the extent the law allows, you use our products and exercise content at your own risk.

4. Exercise information is not medical advice

The workouts, exercise cards, exercise library, FAQs and other content we provide are general fitness information. They are not medical advice and don't replace guidance from a doctor, physiotherapist or qualified fitness professional who knows your situation.

Customer reviews reflect individual experiences, and your results may differ. Reviews may be edited for length and clarity.

Instructors who use AguaForce weights in their classes or training sessions are responsible for the safety of their participants, including checking that exercises and weights suit each person.

5. Products and prices

We try to describe and show our products accurately, but colors can look different on your screen, and details such as packaging or included extras may change from time to time.

Prices are in US dollars and can change at any time. The price that applies to your order is the one shown at checkout when you place it. Sales tax, where it applies, is calculated at checkout.

If a product is listed at the wrong price or with the wrong information because of an error, we may cancel orders placed with that error and refund them in full. We may also limit the quantity per order. Larger quantities are available through our wholesale program.

6. Orders and payment

Checkout is handled by Stripe, our payment processor. You enter your payment details on Stripe's secure checkout page, and we never see or store your full card number. By placing an order, you confirm that you're authorized to use the payment method you provide.

We email you a confirmation once your payment is confirmed. Some payment methods, such as bank debits, take a few days to clear; we prepare your order once they do and email you if the payment fails. We may decline or cancel an order, for example if payment fails, we suspect fraud or a product is unavailable. If we cancel an order you've paid for, we'll refund you in full.

If you choose to pay in a currency other than US dollars, the amount in your currency is shown at checkout before you pay.

Promotion codes are subject to any conditions stated with them, have no cash value and can't be combined unless we say otherwise. We may change or end a promotion at any time.

Your confirmation email links to a page where you can check your order's status. Anyone who has that link can view the order, so please keep it private.

7. Shipping

Shipping is free on online orders. We currently ship to addresses in the United States and Canada. Delivery times are estimates, not guarantees.

Please double-check your shipping address at checkout. We're not responsible for delays or losses caused by an incorrect address, but contact us as soon as possible and we'll do our best to help.

Orders shipped to Canada may be subject to import duties or brokerage fees. Any such charges not collected at checkout are your responsibility. Ownership and risk of loss pass to you when your order is delivered.

8. Returns, refunds and our 30-day guarantee

• 30-day money-back guarantee. If your AguaForce weights break within 30 days of delivery, you get your money back.
• Free returns. You can return an online order within 30 days of delivery. Returns are free for one set per order, so if you order two sets, one of them can be returned free of charge. Return shipping for any additional sets is at your cost.

To start a return or a guarantee claim, email us at info@aguaforce.com with your order number, and we'll reply with instructions. Refunds go back to your original payment method and can take several business days to appear, depending on your bank.

Wholesale orders follow the terms agreed for that order. Nothing in these Terms limits any rights you have under the consumer protection laws that apply to you.

9. Contact and wholesale requests

You can reach us through the contact form on the Site or by email. Please give accurate contact details so we can reply. Our Privacy Policy explains how we handle what you send.

Instructors, studios, facilities and retailers can request wholesale pricing through the Site. Sending a request doesn't place an order or create a contract. Wholesale pricing, quantities, payment and delivery are agreed separately in writing, and free samples are offered at our discretion.

10. Our content and trademarks

The Site and its content, including the AguaForce name and logo, product designs, photos, videos, text, exercise cards and exercise library, belong to AguaForce LLC or our licensors and are protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use, and search engines and AI tools may use our public pages as described in Search engines and AI tools. Otherwise, you may not copy, modify, distribute or otherwise use our content or trademarks without our written permission.

If you send us feedback or ideas, we may use them without any obligation to you.

11. Other websites and services

The Site links to services we don't control, such as Stripe's checkout page and our social media pages. Their own terms and privacy policies apply, and we're not responsible for their content or practices.

12. Disclaimers

We work hard to keep the Site accurate and available, but we provide it “as is” and “as available.” We don't promise that it will always be available or error-free, or that its content is complete and up to date. To the extent the law allows, we disclaim all implied warranties for the Site and its content.

Our products come with the 30-day guarantee described above, along with any warranties that can't be excluded under the law that applies to you.

13. Limitation of liability

To the extent the law allows, AguaForce LLC and its owners, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Site or our products. Our total liability for any claim relating to the Site or an order is limited to the amount you paid for that order.

Nothing in these Terms excludes or limits liability that can't be excluded or limited by law, such as liability for death or personal injury caused by our negligence, or for fraud.

14. Indemnity

If you break these Terms or misuse the Site or our products, and someone else makes a claim against us as a result, you agree to cover our reasonable losses and costs, including legal fees, to the extent the law allows.

15. Governing law and disputes

If you have a problem with the Site or an order, please contact us first. Most concerns can be resolved quickly that way.

These Terms are governed by the laws of the United States and of the state in which AguaForce LLC is organized, without regard to conflict-of-law rules. If you're a consumer, you also keep the protection of any mandatory laws of the place where you live.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the “Last updated” date above. The version posted when you place an order applies to that order, and continuing to use the Site after an update means you accept the new Terms.

If any part of these Terms is found to be unenforceable, the rest stays in effect. If we don't enforce a provision right away, we haven't given up the right to enforce it later.
